These terms of service (hereinafter: "Terms") apply to all offers, quotations, sales, and agreements between SunTeg Solar B.V. (hereinafter: "SunTeg", "we", "us") and the buyer (hereinafter: "you", "customer"). By using our website or entering into an agreement with us, you agree to these Terms.

1.3 Amendments

We reserve the right to amend these Terms. Amendments will take effect 30 days after publication on our website. In the event of material changes, we will inform existing customers by email.

2. Products and Services

2.1 Product Range

SunTeg sells the following products and services:

Solar panels and associated installation
Home batteries and associated installation
Charging stations and associated installation
Heat pumps and associated installation
Air conditioners and associated installation
Installation of underfloor heating (excluding materials)

2.2 Product Information

All product descriptions, specifications, images, and prices on our website are indicative. Small deviations in color, size, or specifications are possible. Final specifications will be confirmed in the quotation or order confirmation.

2.3 Availability

All offers are valid as long as stocks last. If a product is not available, we will inform you and offer an alternative or dissolve the agreement at no cost to you.

3. Formation of Agreement

3.1 Offer and Acceptance

An agreement is formed by your acceptance of our quotation or by placing an order via our website
We reserve the right to refuse or cancel orders
All prices include VAT, unless stated otherwise

3.2 Age Restriction

Our services are exclusively available to adults (18 years and older). By placing an order, you confirm that you are of legal age.

3.3 Order Confirmation

After placing your order, you will receive an order confirmation by email. Please check it carefully and report any inaccuracies immediately.

4. Prices and Payment

4.1 Prices

All prices are in euros and include VAT
Shipping costs and installation costs are calculated separately and stated before placing the order
Prices may change without prior notice

4.2 Payment

Payment is made via the available payment methods on our website
For installations, an advance payment may be required
In the event of late payment, we are entitled to charge statutory interest and collection costs

5. Delivery and Installation

5.1 Delivery Time

The normal delivery time for products is 2-5 working days after order confirmation, unless otherwise agreed. For installations, we will schedule an appointment after delivery of the products.

5.2 Delivery

Delivery takes place at the address provided
In case of absence, delivery will be rescheduled; any additional costs will be at your expense
Risk transfer occurs upon delivery

5.3 Installation

Installation services are carried out by qualified technicians
You must ensure accessibility to the installation site
Installation takes place on working days, unless otherwise agreed
If the customer fails to comply with agreements, rescheduling costs may be charged

6. Warranty

6.1 Legal Warranty

You are entitled to the statutory conformity warranty of 2 years on all products from the date of delivery.

6.2 Commercial Warranty

SunTeg offers a 2-year full warranty on all delivered products and performed installations, unless the manufacturer's warranty is longer.

6.3 Warranty Conditions

Warranty does not apply to normal wear and tear, improper use, or self-repairs
Warranty claims must be reported in writing via info@sunteg.nl
Warranty becomes void if the product is altered by third parties

7. Right of Withdrawal (Consumer Purchases)

7.1 Cooling-off Period

You have the right to cancel your order up to 14 days after the day of receipt without giving any reason. After cancellation, you have another 14 days to return your product.

If you exercise your right of withdrawal, the product with all supplied accessories shall be returned to the entrepreneur in its original condition and packaging, if reasonably possible. Should the product be damaged or the packaging more damaged than necessary to sell the product, we may pass on this reduction in value of the product to you. Please handle the product with care and ensure it is properly packaged for return.

To exercise this right, please contact us via info@sunteg.nl. We will then refund the amount paid for the order within 14 days of receiving your return notification, provided that the product has already been received back in good order.

7.2 Exceptions

The right of withdrawal does not apply to:

Custom-made products
Products and systems already installed
Services performed with your express consent

7.3 Exercise of Right of Withdrawal

Report your withdrawal in writing to info@sunteg.nl. Should the product be damaged or the packaging more damaged than necessary to try the product, we may pass on this reduction in value of the product to you. Please handle the product with care and ensure it is properly packaged for return.

8. Returns and Refunds

For detailed information about return procedures, please refer to our separate Return and Refund Policy, which forms part of these Terms.

9. Liability

9.1 Limitation of Liability

Our liability is limited to direct damage and to a maximum of the amount of the agreement concerned. We are not liable for indirect damage, consequential damage, lost profits, or intangible damage.

9.2 Exception

The limitation of liability does not apply in cases of intent, gross negligence, or damage resulting in death or personal injury.

9.3 Limitation Period

All claims against SunTeg expire after 1 year from the moment you became aware or reasonably could have become aware of the facts on which the claim is based.

10. Force Majeure

In the event of force majeure (including pandemic, government measures, strikes, supplier problems), we are entitled to suspend the execution of the agreement or to dissolve the agreement without compensation.

12. Complaints

12.1 Complaints Procedure

Complaints can be submitted via info@sunteg.nl. We aim to handle complaints within 14 days.

In case of complaints, a consumer should first contact the entrepreneur. If the webshop is affiliated with WebwinkelKeur and in case of complaints that cannot be resolved by mutual agreement, the consumer should contact WebwinkelKeur (www.webwinkelkeur.nl), which will mediate free of charge. Check whether this webshop has a current membership via https://www.webwinkelkeur.nl/leden/. If a solution is still not reached, the consumer has the option to have his complaint handled by the independent dispute committee appointed by WebwinkelKeur, whose decision is binding and both the entrepreneur and the consumer agree to this binding decision. Submitting a dispute to this dispute committee involves costs that must be paid by the consumer to the relevant committee.

13. Intellectual Property

All intellectual property rights concerning our website, products, and services belong to SunTeg or our licensors. Unauthorized use is prohibited.

14. Final Provisions

14.1 Applicable Law

These Terms and all agreements are governed by Dutch law.

14.2 Competent Court

All disputes will be submitted to the competent Dutch court in the district of SunTeg's place of business.

14.3 Validity

If a provision of these Terms is void or voidable, the remaining provisions will remain in full force.

14.4 Translation

In case of discrepancies between the Dutch and any translations of these Terms, the Dutch text shall prevail.
